Question for the second trial (if there is one). Could Reddington make it part of his strategy in another trial to sort of break the fourth wall and explain in opening that the court, by not bifurcating the trial, has forced him into a near-impossible situation of having to argue at the same time that his client did not do the crime/there is not enough evidence to convict, and also that IF she did the crime, she was not criminally responsible (à la your video explaining exactly that difficult situation and how he still managed to do it well), then split his case argument in half, first presenting all the holes in the prosecutions case, then stopping and re-explaining that he must now make arguments that effectively presume her guilt but that it is not evidence that she is guilty, and present the insanity defense? 1. Is that allowed? And 2. Do you think that would be a good strategy and help the jury understand better that the prosecution does still have to prove she did it?
