there is no preliminary injection. The legal landscape regarding state and local law is settled against recording. If given a lawful or to stop recording or leave, you can be arrested and the charges will most likely stick so long as the police can prove you were given a lawful order. The first amendment challenges still remains unsettled in Federal Court. So that's the current status of the Reyes vs. city of New York.
