@theclancyfiles: Lindsay Clancy returns to court after mistrial. Lindsay could win her double-jeopardy argument, but it is not automatic. The important issue is why the first trial ended in a mistrial. Normally, when a jury is deadlocked and a mistrial is declared, the prosecution can retry the defendant without violating double jeopardy. But Reddington is arguing something more specific: The jury was 11–1 on the issue of criminal responsibility. The defense says the one holdout juror was not properly applying the judge’s instructions. Reddington argues the judge should have investigated that issue before declaring the mistrial. Therefore, he argues there wasn’t sufficient legal justification called “manifest necessity” for ending the trial. #lindsayclancy #patrickclancy #patrickclancy #kevinreddington #lindsayclancycase
