The entire point of FMLA is to hold your position or a position with the same type of work and pay. If the company doesn't honor that it's a monster lawsuit. Don't even complain to the company just get a lawyer and continue working. Don't talk bad about the company to coworkers or even discuss the situation. And stay off of social media talking about it.

I worked in law firms for 20 yrs. You’re entitled to be restored to the same position you held before leave, or to an equivalent position — meaning equivalent pay, benefits, and other terms and conditions. A pay reduction, especially where your agreement was forced as a condition upon return, would violate that restoration requirement unless it applies to everyone in a legitimate way (like a company-wide pay cut that hits all employees in your role, not just you as a condition of returning), or if your job was truly eliminated and the employer would have to show proof.

There is also an important pay protection when you return: the restored position generally must have equivalent pay, benefits, schedule/opportunities, and employment terms. An employer cannot reduce your pay, demote you, take away shifts, or otherwise penalize you because you used FMLA.

If the pay cut is not because of fmla, yes. They can. For example, if everyone got a pay cut while you were out, they can cut your pay too. If it’s JUST you and no one else in your position, I would file a complaint

from an HR perspective (and i really hate to say this) it actually depends... is the reason for the pay cut because you took leave? or for example, did 25% of the workforce also receive a pay cut during the time you were on leave?
