Jack Smith told senators he would charge Trump again. The former special counsel, who led two federal cases against Donald Trump in 2023, testified before the Senate Judiciary Committee on Sept. 29, 2026, and defended his work under oath. Smith said his investigation developed “proof beyond a reasonable doubt” that Trump “engaged in serious crimes against our nation.” He said he would bring the same case today against any former president, “Republican or Democrat.” The two cases involved Trump’s efforts to overturn the 2020 election and his handling of classified documents after leaving office. Neither reached a jury. Both were dropped after Trump won the 2024 election, because Justice Department policy bars prosecuting a sitting president. Trump has denied wrongdoing and has called the prosecutions a political witch hunt. Republicans used much of the roughly four-hour hearing to accuse Smith of abusing his power and targeting conservatives. Chairman Chuck Grassley called Smith’s office “a partisan weapon that broke the rules.” Ted Cruz accused him of unprecedented abuse, while John Kennedy told Smith, “You make me want to throw up in my mouth.” One of the strangest moments came when Sen. Eric Schmitt accused Smith of lying about attending an Atlanta Hawks game and implied it connected him to Georgia prosecutors. Smith said he had actually attended an Iowa Hawkeyes women’s basketball game in Maryland to see Caitlin Clark play. Democrats said the mix-up undercut the accusation. Smith also defended subpoenas for lawmakers’ phone records, saying they involved call logs, not call content, and were relevant to the Jan. 6 investigation.
