Kohen was inside with his mother and a family friend. Months later, newly released footage has brought renewed attention to his death and the decisions made in those final seconds. On October 23, Senatobia’s mayor confirmed Foster had resigned. Earlier that week, the Mississippi Attorney General’s Office concluded that his use of force was justified and cleared him of criminal wrongdoing. Foster’s attorney has maintained that the vehicle was moving toward the officer and that he had no choice but to fire. Kohen’s family strongly disputes that account. Attorney Ben Crump, who represents the family, says the footage shows the fatal shot came from the side of the vehicle and disputes that Foster was in imminent danger. The family’s legal team is calling for a federal investigation and for Foster’s police certification to be revoked. As of October 23, state officials said he remained certified, meaning his resignation alone would not prevent him from working for another police department. Authorities alleged that Kohen’s mother and her friend had stolen diapers. His mother has denied that allegation, and neither woman had been charged as of the latest reporting. Kohen would have turned 2 on November 1. Instead of preparing to celebrate that birthday, his family is continuing to demand accountability for his death. For them, an officer leaving his job does not resolve the questions surrounding the loss of their child.
