somebody else also said it, but I'm going to reiterate it - that motion also serves as a warning to the DA's office. Reddington can change his defense strategy to a third party defense, if the Commonwealth tries this again. that would be very, very stupid for them, so this would be a good way to get a plea from them, a very favorable to Lindsay plea offer. I made a video suggesting that he might do that weeks ago, so him going up there on Tuesday really just kind of confirm to me that he's basically warning them that that might be his next move. they all know they don't have the evidence to actually prove that she did it, it's Redington gets up there and starts poking even more holes in their story. he was playing nice during the first trial, not flat out denying that she did it. if he goes in with that strategy on a second trial, they don't have a shot in hell of winning, the best they could hope for is a second mistrial. he can pop some new experts on that stand to counteract things like the body core temperature and Lindsay's admissions, and he just had the entire internet doing years worth of research for him in 2 months, so I'm sure some new things have come up that have the wheels in his head spinning. and the prosecutor was flustered by what he said, which is why she went up and just said "nuh uh, we have evidence!".

Dr Laposta didn’t say such a thing. She never specified the timeframe. Nobody is arguing that’s inherently impossible to loose that much heat. That would go against the laws of thermodynamics. It’s just not possible in that timeframe

I have a very real issue with the judge denying both the Bowden defense AND this. Denying the Bowden essentially just refused to properly educate the jury on all available options (which should happen regardless), and now that we know that the jury WAS CONFUSED, and we have seen this stunningly poor investigative work, he wants to then continue to give the CW chances to keep fucking up?! Our justice system is so wildly fucked it is insane.

I think if Reddington had pushed the lack-of-evidence argument harder during the first trial, the judge may have had more to work with. He did touch on it, but he didn’t raise all of the specific points he later relied on in the hearing. That’s probably why it would have been hard for Sullivan to rely on those arguments and rule in his favour because they weren’t fully developed at trial. And the beyond a reasonable doubt standard applies to the evidence as a whole. X
