@channelnewsasia: Clients of interior design firm Axion Design were left in the lurch recently after its co-founder said the company had gone bankrupt. Amid concerns over the ease with which individuals can set up renovation businesses, litigator Pang Khin Wee explains that a company and its owner are separate legal entities, and what that means for homeowners trying to recover their money. What options do homeowners have when a renovation company shuts down, owing them money and unfinished work? Find out this and more on the Deep Dive podcast. #DeepDivePodcast #singapore #renovation

Singaporean is funny, as what the lawyer mentioned in the video, you can go after Steven if you engage Steven personally. But reality is, no Singaporean will engage an ID without a company, at least for me. When I work as freelance ID after my Poly, the most common question from customers are: Where is your showroom? Why you do freelance? Where to find you if you run away with my money? And when I explained to them that you can sue me personally if I run away with your money but Pte Ltd cannot and most of them won't believe.

It honestly feels like there are still serious gaps in consumer protection for homeowners. Renovators can collect large upfront payments, leave projects incomplete, stop responding, and consumers are then left to spend even more time and money pursuing legal remedies. Even after obtaining a court judgment, enforcement can still fall on the homeowner. Where is the real deterrence and accountability? What is even more worrying is when a renovation company can cease operating, while the people behind it may later continue the same type of business through another company. If there are no stronger safeguards against repeated conduct, what actually prevents the same thing from happening to the next homeowner? Consumers have to fight this hard just to recover their own hard-earned money? while the director who responsible for the way a company was run appear to face no immediate consequence, it raises even more questions about accountability and consumer protection. It feels hopeless.

when banks loan to private limited companies, they get the director to sign personal liability... if a similar requirement is is mandated, this loop hole can be plugged

our government is pro-companies for the sake of the GDP and luring overseas investments, that's why things like these are allowed to persists consumer and employee rights are at the lowest rung of the GDP foodchain. you have a better chance winning TOTO than getting the authorities to help retrieve your monies lost
