One of the officers walked into the room, saying "do you want to be sprayed or Tasered? Two police officers who Tasered a 92-year-old amputee at a care home have been sacked for gross misconduct. PC Stephen Smith and PC Rachel Comotto will also be placed on police’s barred list following a disciplinary hearing which concluded on Tuesday, which followed an investigation by the Independent Office for Police Conduct (IOPC). PC Smith and PC Comotto were called to Park Beck care home in St Leonards-on-Sea after resident Donald Burgess, who had dementia, threatened carers with a dinner knife in June 2022. Mr Burgess was hit with a baton, pepper sprayed and Tasered as he sat in his wheelchair in his bedroom. The officers involved, who were both acquitted of assault occasioning actual bodily harm in May 2025, were found to have used "unjustified and excessive use of force" at a hearing at Sussex Police headquarters in Lewe. Mr Burgess was taken to hospital after the incident, where he contracted Covid and died 22 days later. The officers were not held responsible for his death. The misconduct panel found PC Comotto, 37, and PC Smith, 52, did not attempt to de-escalate the situation before using force and breached standards of professional behaviour. The panel heard that the officers acted “hastily, harshly and lost control”. Body-worn camera footage showed Pc Smith walking into the room and saying: "Do you want to be sprayed or Tasered? It's up to you. Can you put that down for us?" Mr Burgess refused to put the knife down, but the panel found PC Smith made “no attempt to assess or understand” the care home resident’s vulnerability and PC Comotto “showed no compasion”. Assistant Chief Constable Peter Gardner said Mr Burgess was in his own room, isolated from residents and posed no risk. IOPC Director of Engagement Emily Barry said: “Any use of force should have been a last resort and only used when necessary. Rather than de-escalating the situation they immediately threatened Mr Burgess with force and then discharged PAVA spray, struck him with a baton and Tasered him when he didn’t drop the knife. “Their actions were clearly excessive and unreasonable and PC Comotto then displayed further poor judgement by joking about Tasering Mr Burgess on social media afterwards.”
