I actually have a somewhat different theory than the ones presented in your video. I believe Redington made a judgment call to stay focused on the not guilty by reason of insanity defense. I think his original motivations probably included what was best for Lindsay, including what had the best chance of success of keeping her out of prison. I also believe that she believed that she did this at least at the start of this trial, and that does matter. And had the trial been split, it would’ve negated a lot of traumatic testimony, particularly the children’s autopsies, which was horrifically traumatic for Lindsey. I believe he was well aware of the deficiencies of the case, but he was choosing to focus and hoping that the trial would be split and he could stipulate so it could be focused even better. When that got denied, he was put in a position of choosing to essentially fight with one hand voluntarily tied behind his back or trying to fight both battles at once and risk confusing the jury. I think if he had done this, there’s a chance the jury could’ve been further split into not guilty, not guilty by reason of insanity, and at least one but potentially more guilty. I think the fact that he was almost successful in spite of all of that, 11 to one, is proof that was the correct choice, even if it sacrificed displaying the insufficient investigation. You could feel as frustration at certain points. The reason he unloaded in this hearing also makes sense in multiple ways. There was no longer a jury to confuse. He was speaking primarily to other Legal professionals. He was speaking to the judge to remind him that this wouldn’t have happened if he had just granted the split. He was speaking to the prosecution and DA to let them know just how much ammunition he has for a re-trial should he choose to challenge it second time around. And he may have also been speaking to Lindsay. I think we’ve seen her change over the course of the trial, and I do think part of that might be that she’s seeing all of the problems in the case against her. This would have supported that again.
