Why do we hold drunk drivers responsible for killing others in car accidents if “being too intoxicated” means you’re somehow not responsible for your actions? Calling this law a loophole implies that something is wrong with the current law, but I think it’s just consistent with the idea that you’re still responsible for your choices when intoxicated.

it's a good law, it doesn't stop assault charges if the person doesn't consent or is unable to consent because they're unconscious. it would be ridiculous to say a person can't consent to intimacy the second they have any alcohol.

It’s not a loop hole it is reality if you willingly create conditions where you increase the odds of yourself being a target then you partially share the responsibility if in the future you do become as a target.

The point of this law, which isn’t a loophole as it is stated in plain language, is because often times both parties have been drinking or doing recreational drugs, so if you claim intoxication removes one’s ability to consent, then inversely it removes one’s ability to determine the other person can’t consent!

I was charged with batery when I was blackout drunk because the courts knew is was my choices that led to me going crazy. getting wasted is a choice and whatever happens is on you.
