@bradbernsteinlaw: Applying for a green card? The public charge rules changed on September 18, 2026 — and benefits that previously fell outside the analysis may now receive much more scrutiny. Under the new rule, immigration officers have broader discretion to look at means-tested public benefits and your overall financial circumstances when deciding whether you’re likely to become a public charge. That does NOT mean receiving Medicaid, SNAP, housing assistance, or another benefit automatically gets your green card denied. Public charge is still evaluated based on the totality of your circumstances. Your filing date matters. Your immigration category matters. And some applicants — including certain refugees, asylees, VAWA self-petitioners, and U- and T-visa applicants — may be exempt from the public charge ground altogether. Most importantly: don’t cancel benefits based on a TikTok video. Have a qualified immigration attorney review exactly what benefit is involved, who receives it, when it was received, and how the new rule applies to your case. what if, I was/am temporarily homeless because the Turkish government held me in a camp for 5 months, then beat me nearly to death and dropped me off in New York, no money, job, place to live, leaving my Turkish fiance behind and the hospital that treated me on arrival got me put into a shelter and applied for Medicaid to cover the costs.
