I just got hired somewhere, and I was faced with this exact dilemma. First time in my life. I did consider backing out of the role solely because of the arbitration agreement but as you mentioned the job market is so tough, I just had to go forward with employment anyway and hope for the best. It did make me extremely uncomfortable.
