Misdemeanor compromise is a subtle admission.
its going to be on his record
Let it go to trial
he should get a not guilty verdict
and he should sue the store

Didn’t your client have printed receipt of the items he bought? This happened to me in Atlanta 2 weeks ago. I forgot one of the items I paid for and took the remaining items out of the supermarket. When I remembered I went back to the store and showed my printed receipt to the cashier who confirmed that I actually paid for the item left behind. I just took my forgotten item and went out of the supermarket. Simple

countless people on daily basis forget to pay for things on thier cart , especially if the cart was a heavy one (the associate will always remind you that you have a thing you didnt pay for) .... to prove something was shoplifting, it has to be proven that he intentionally left the stuffs in his cart so as not to pay for it.... that misdemeanor will be on his record, its not diffrent than pleading guilty ... he dosent need that in his record... there are cameras all over the store that filmed him the moment he entered into the store... ask him well if he knows it was not a deliberate act of stealing.... if he insists ... you can get the judge to petition the store for a copy of the cctv on that day...he has alot of chances to not only get free with a jury trial but to also sue the store for false accusation and be compensated.... but i repeat ask him well because those people know what they are doing...they watch his every move...if he is not sure of himself...let him just take that other option.... that can ruin his life if he is found guilty ....

this wont happen in uk. its common sense to see it as a mistake and either take wats not checked or ask him to pay

he need to be very carefull,he bought a lot of things, they knew he did not pay for that single items because they knew before he got to the exit, how did they know, the camera,it will come to play at trial,if there is any doubt about his intention if they watch the camera its trouble and once he reject the prosecutor offer that will spir him to come after your client.

Misdemeanor compromise is fine provided it’s not going to be on his or her record. Peace sometimes is fine. If it’s going to be a blemish on his or record then you can go for trial.

Jury trial in so far your are ready to strenously defend your client. It is silly to have charged the person.

I believe Jury trial is the way to go. E no kill person. This can happen to other people as well. I believe your client will get a not guilty verdict and his record clean with the Jury trial.

As a former retail manager, I would have asked him to pay for the item or collect the item since he paid for the remaining item. He is a paying customer after all. Sensible discretion matters!

I think it's better to face the Jury and defend him rather than falling for the so called 'misdemeanor compromise ' which I think is a trap to pin a shoplifting crime against his green card.

I feel it's better to go for a misdemeanor compromise. It will save him stress, cost and uncertainty especially if it will be off his record.

Would the misdemeanour compromise ever show on his record as a conviction or not. If it won’t show, then that is the best route for him to take because if he goes to jury trial, that would cost him so much money and hey, technically , theft is defined as dishonest intent to permanently deprive the shop of the item and he can’t be sure that he won’t be convicted based on the fact. If he did self check out on the counter, the intent element may be difficult for him to rebut.
