California Child Support: the whole thing in 40 seconds. The formula is in Family Code section 4055: CS = K × [HN − (H%)(TN)]. HN is the higher earner’s net monthly disposable income. TN is both parents’ combined net disposable income. H% is the higher earner’s approximate share of time with the children. K is the fraction of combined income the Legislature has decided should go to the children, and it slides with income and with timeshare. For more than one child the result is multiplied: 1.6 for two, 2.0 for three, and so on up the table in section 4055(b)(4). A few things the forty-second version leaves out. “Net disposable income” has its own statutory definition (sections 4058 and 4059), and getting it right is where most of the fights are: what counts as income, what comes off the top, and how you treat overtime, bonuses, rental income and self-employment. Timeshare is a percentage of time, not a count of “custody,” and 50/50 on paper is rarely 50/50 in hours. The formula result is the base; child care and uninsured medical costs are added on top under section 4062. And for a parent with very low net income there is an adjustment under section 4055(b)(7). The guideline result is presumptively correct (section 4057(a)). A court can depart from it, but only on the grounds listed in section 4057(b), and only with written findings (section 4056).
