@ktcrimlaw: I am not telling you that every witness should be credited or believed. In many cases, witnesses should be discredited, and in others it may be impossible to know with certainty whether their testimony was truthful and accurate. This video is about the legal status of witness testimony in court and how to articulate concerns about witness testimony while still sounding informed. #criminallawyer #truecrime #criminallaw #crimejunkie #lawyer
can you also do a video explaining that almost all evidence is circumstantial (even DNA). I'm sick of people saying that the evidence against Lindsey is circumstantial as though that is synonymous with weak

It is but heavily influenced by ulterior motives and roughly 40% of it is false so I would not put too much weight on it.

I have this conversation with my clients all the time when they ask “what’s the evidence against me?”

If witness testimony wasn’t evidence there would be zero reason to even have trials the way we have them today

witness testimony is evidence. but it is one of the least reliable types of evidence.

hey I have seen a user here under the name legally_cortney who claims to be an attorney saying that the defense is keeping his best evidence for the next trial. Do you agree with her because I don't understand why would he not use them in the first trial???

I mean that’s kinda why witness testimony is so unreliable… it’s still a valid statement though

Yes, sworn testimony is evidence, but in some cases easily impeached especially when there are prior statements.

This is deliberately misunderstanding the point. There’s a difference between evidence in the legal sense and in the colloquial sense. Colloquially people use “evidence” in place of “good and valid evidence” and so often witness testimony is not that

Can you make a video about what prosecutors might change if this case goes to trial again?

Indeed, other forms of evidence need to be sponsored by a testifying witness

People attack Patrick saying he’s lying. But Lindsay can easily take the stand and disprove his statement. Why doesn’t she?

Corollary: a witness going on the stand and telling you his experience of what happened during a crime is not *hearsay*.

Rotty :
Calling testimony evidence tells us that the jury may consider it. A person's assertion that something happened doesn't establish that it happened. If the only justification for believing someone is that they made the allegation, the reasoning begs the question. It assumes the reliability that needs to be established. We should proportion our belief to the evidence, not what gets to be treated as evidence in the legal sense.

If there’s only witness testimony and the accuser and accused testimonies’ completely contradict each other, there’s no evidence

1st hand witness testimony is evidence. 2nd hand is not. Also 1st hand witness testimony shouldn't always be considered good evidence. people remember stuff wrong all the time.

Maybe I missed to context but this is true in a court of law, when a witness is risking perjury and has made a sworn claim. Outside of a court, nope. A rando on tik tok in the comments whose name is user3858626374 and does have a profile picture telling me what they saw is not evidence.
