This does not mean automatic documentation. According to South African law, an asylum seeker is a person who has requested protection and whose claim is still being assessed, while a refugee is someone whose claim has been formally approved. Currently there are two distinct Constitutional Court judgments. In the May judgment, which the Department of Home Affairs won, the Court held that an applicant whose asylum claim has been finally rejected after exhausting all available remedies may not submit a fresh application and must leave South Africa. The more recent judgment concerns foreigners who have not yet had their protection claims heard: the Court held that they may not be blocked automatically from accessing the asylum process and must be given an opportunity to present their claims, in line with the principle of non-refoulement. Home Affairs is implementing the recent judgment by directing Refugee Reception Offices at Home Affairs to receive and assess these claims on their merits. This provides access to the process; it does not automatically confer asylum or refugee status, and it does not reverse the May judgment.
