But why are they not explaining the part that once they apply, legally they can not be deported until they get an outcome on the case so if it takes home affairs 10 years they would technically be “legalised” in those 10 years

We understand the Constitutional Court judgment, but the real issue here is about undocumented immigrants staying in the country illegally while waiting for their status to be approved or rejected. Given our current system, processing can take years. In a way, this contradicts the fundamental law that states if you enter the country illegally, you must be arrested and deported. Because of this directive, when illegal immigrants are caught, they can simply claim they have applied for asylum and are waiting for outcome meaning, technically, you cannot deport them. In my view, the ruling should have been that while they are permitted to apply for asylum, they cannot remain in the country while awaiting the decision. I think that is the root of our concern
