But despite what some reports may call it, he was NOT sentenced today. Judge Joseph Bulone previously found two aggravating factors proven beyond a reasonable doubt financial gain and cold, calculated and premeditated murder while rejecting the claim that the murder was proven to be especially heinous, atrocious or cruel. Because Kosowski waived his right to a jury and continues to represent himself, Judge Bulone will ultimately decide whether his sentence is death or life without parole. The court also appointed special counsel to investigate mitigation, including possible evidence about Kosowski's background and family, despite Kosowski choosing not to present his own mitigation case.
