The mighty Buganda kingdom attained her independence on the 8th October 1962 followed by Uganda as a nation on the 9th October 1962. What happened on 8th October? Inside the new Bulange Hall at Mengo, His Royal Highness Prince Edward, the Duke of Kent, signed and handed over a legal instrument of independence for Buganda Kingdom. That instrument terminated all the old agreements Britain had with Buganda: • 1893 Agreement • 1894 Agreement • 1900 Agreement • 1955 Agreement • 1961 Agreement The ceremony was witnessed by Governor Sir Walter Coutts, Prime Minister Milton Obote, visiting Jomo Kenyatta and Tom Mboya and all Buganda Kingdom leaders. What were the terms under the 1962 Independence Constitution? Buganda did not become a separate country though it was before the coronial era, It entered Uganda as a full federal state different from other kingdoms. 1. Federal Status: Buganda was granted full federal status, while Ankole, Bunyoro and Toro together with Busoga received semi-federal arrangements. 2. Powers of Lukiiko: The Lukiiko was given powers over Kabakaship, customary law, local government and traditional land tenure. 3. Own Institutions: Buganda had its own financial arrangements, a local police force and a High Court for matters within its jurisdiction. 4. Representation: Buganda's Lukiiko could decide whether its 21 MPs in the National Assembly would be elected directly or selected indirectly by the Lukiiko. It chose indirect, which allowed Kabaka Yekka to take those seats. 5. Head of State Promise: As part of the UPC-KY alliance, the Kabaka the Head of State of Uganda which he became in 1963. On 8th October 1962, Buganda did not just celebrate. It signed a legal contract to enter Uganda as a FULL FEDERAL STATE with its own Lukiiko powers, its own police, its own High Court, its own finances, and its own land system. That contract was broken in 1966 when the 1962 Constitution was abrogated, the federal status was abolished by force, the Buganda Police and Prisons Service badges you see above were disbanded, and Mengo was attacked. In 1993, the Kabakaship was restored, but only as a cultural institution not as the federal political entity agreed upon at Bulange on 8th October. So the honest question for Uganda today is this: Does Uganda as a nation still respect the terms it agreed upon with the Buganda Nation a nation of over 12 million people, that sits at the centre of the country and holds the backbone of the national economy, the capital, the tax base, and the industrial heartland? If the answer is yes, then let the original federal terms be respected in practice true federalism, respect for Buganda land, finances, and institutions. If the answer is no, then we’re right to whisper a new word: BUGEXIT BUGEXIT not as a call for violence, but as a call to re-examine whether the 8th October 1962 Instrument of Independence still has meaning, or whether Buganda must renegotiate its place in Uganda.
