A patent on "3 stripes" isn't a patent on "4 or more stripes". Does a 16 oz cup infringe on the patent of a 12 oz cup based on similarity of the designs' capacity? If not, then Adidas should lose this case.

O'Neills in Ireland uses 3 stripes spice before Adidas. Adidas tried to stop them anyway but failed although O'Neills can't sell them abroad
