@honeybeeabs: Replying to @Vanessa Lennar home update! I had a 2nd Type B inspection completed this past Tuesday. Everyone is communicating and cooperating. Lennar has agreed to make repairs, we are in a holding pattern to see if we can prevent the foundation from having additional movement or if we will need to undergo foundation repair. More updates to come! #lennarhomes
You still need an attorney on retainer that way everything is done correctly give 5yrs and the whole house will settle and fall

Not retaining an attorney is just wreckless my dear.

I’m one of the ones that continues to encourage you to retain council.. as a GC, the only way you can fix this is piers.. but that doesn’t mean it will be fixed correctly. They may counterbalance your house and then the other side will end up dropping. Your foundation wasn’t prepped right & your footing was likely not poured deep enough. I truly can’t stress this enough, you aren’t dealing with something that they can assess and casually fix. If you don’t fully understand foundation plans & peering you should retain someone solely on your team alone. I wouldn’t give this advice for the hell of it. I’m literally building someone a new house bcs of this exact issue from their previous builder who engineered a set of plans for piers and it fixed the side of the house that was sinking and didn’t fix the other. Piers are incredibly expensive, it is not within your builders scope, they will have to hire someone to do it, therefore they won’t get a discount & you will be left with the results and can only pray they did it right. My last piece of advice.. they are only being nice bcs they have to be so you don’t take them to court. Getting help from an attorney doesn’t mean you are suing them, it just means someone legally has YOUR back. I can assure you sister, they have their own back only.

They will act cooperative until they find their loophole and won’t pay a dime. Trust me I’ve been through it with them.

It’s our clay soil, they are just playing dumb with you and they know exactly why it’s moving. The foundation is designed to flex and it will continue to “settle” forever until they stabilize it. I went through the exact same thing with them. Wait until we have another big rain, it will move again. I also went with a similar flooring option and it pulled apart when the foundation moved.

Hubby has been in construction for over 30 years says it’s clearly they didn’t compact the dirt correctly before pouring your foundation. Poorly compacted dirt will settle as it gets rained on and the house “settles”.

I agree, that it is best to work with them first, and I’m sure that’s what the home warranty says, but. IMO, you have to hire your own attorney or adjuster to negotiate because they are definitely going to do the absolute least amount of warranty repair work.

At that point, you would be better, just going to a different house. That's ridiculous matters will just tear down that whole house. Because if there's one earthquake, that thing's gonna come down in one anyways

If they aren’t demoing your house to build you a new one with a proper foundation then it’s not good enough. If you settle and allow them to run over you then that’s your problem. Good luck.

You have incredible self discipline and class - I’m glad they’re “going through the motions” of doing the right thing - if/when this gets to the point of a lawsuit, your positive cander and complete lack of defamation towards the builder will reflect incredibly well in court

It sounds like they’re waiting you out until they don’t have to actually fix it. How long is the builder warranty? A year? Then you will have to hire someone to inspect the foundation on your own and hire a lawyer to argue with the foundation company to have that repaired under the warranty for your foundation, but that won’t cover the cracks in your house, just the foundation. If the house gets bad enough the house will be unsalvageable; it needs fixed before it gets that bad.

My home needs $180,000 in repairs. I recently recieved the the proposal from the Builders ins. They offered $48,000. Thats 27% of the $ needed.
