I'm disabled and successfully sued my HOA for refusing to put handrails on stairs and a wheelchair ramp from the parking space to the path leading to the front door. This was in a condo so I believe you have a strong case based on the ADA. She is protected by different rules than "them."

You can ask your city for a designated ♿️parking spot on the street. I've seen it where they even put up a sign and everything.

Why was it parked where you knew was not allowed? Was your daughter visiting you and it would not fit in your driveway? Is this the only time the can was left there overnight or is this a frequent occurrence? Did you ever ask the HOA for the rationale behind the parking ban in case it was something like street sweepers? Yes, it would have been kinder to simply leave a notice as a warning. But having a disability doesn’t placard or plate does not automatically exempt you from rules. You have to ask for accommodations first.

Interesting. I have an HOA but they do not own the public street. The streets are the county and we cannot control public parking. Are signs posted? I’d go to the county. Absolutely absurd. I’d also look into a special parking permit from the county. Then small claims to get your money back. It’s a hassle. I’m so sorry your daughter has to fight so much. It’s not fair. 💗

Depending on where you are, you’re City may have to where you can purchase a permit to allow you to park where you need to prevent it from being towed in the future.

Reach out to a civil rights or fair housing attorney, or file a complaint with your state's housing authority or the U.S. Department of Housing and Urban Development (HUD), as many courts quickly order the reimbursement of fees and issue injunctions against discriminatory HOAs.

Call all the news outlets!!! Few years back. They towed a woman’s car in Chicago with handicap parking and it blew up in the news they can take you, but they cannot tow a handicapped parked vehicle. It is the law so them.
