@usupdates5: No federal law stops you from growing tomatoes in your yard. Your HOA, your city, and the contract you signed at closing might. Plenty of homeowners find out the hard way, when a violation notice shows up a few weeks after they plant. What can get you fined or forced to rip out a garden: HOA covenants that require ornamental landscaping only City codes that define front yards as lawn Local bans on raised beds or compost bins HOA fines that can stack up daily until you comply HOAs have real enforcement power because you agreed to their rules when you bought the house. They can fine you, put a lien on your property, and take you to court. Only a handful of states push back. Florida passed the first right-to-garden law in 2019 after Miami Shores forced a couple to tear out a front yard garden they'd grown for 17 years. But Florida's law only stops cities and counties, so a Florida HOA can still ban your vegetables. Illinois passed its own garden protection law in 2021, and California limits HOAs from banning food gardens in backyards. Texas came close this year. A bill protecting yard gardens and backyard chickens from HOA restrictions passed the Texas House 127 to 6, then died in a Senate committee. So in most of the country, an HOA can still tell you what you're allowed to grow on land you paid for. More than 70 million Americans live in HOA communities, and most of them never read the covenants before signing. I'm a property rights guy, and I think growing food on your own land should be about as protected as it gets. If you're house hunting, ask for the HOA covenants before you make an offer, and search them for the words "garden," "landscaping," and "vegetable." #fyp #usa
