understand both sides, but if he's a full time remote worker, with no expectations to show up in the office, why would it be an issue?

First reason is actually valid tbh. Legal teams have to be wary of cross-border concerns. But I agree with the general slant of this video saying that bosses who obsess over your location when you’re WFH are dumb

Only valid reason I see is the possible visa issues if that’s true but I don’t see any reason for the worker to disclose their location if they are a remote worker?

I see the issue with working remotely in a foreign country but besides that, what do they think we do in our off hours? sit down and wait for our next shift?

Remote means not in the office. There is almost never a definition of location. It would also likely be an illegal termination.

Remote working is totally fine, the real concern for working from overseas is two issues, 1) the visa and the legally regarding tax laws. 2) data sovereignty issues, when an employee takes a company device while traveling he could expose company sensitive information if the device gets inspected at country boarders or if gets stolen while traveling. These are legitimate concerns

I do 100% get the idea behind needing to know if you're going to be leaving the country because there is definitely some labor laws that need to be worked on there now if this guy went to key West, shouldn't even be a problem. I do think it still makes sense that you would have to inform your boss that you're going to be working from a different location because they're going to get alerts that their system is being logged on to somewhere else than where they expect it to and that could immediately lead to them thinking that their systems been compromised in some way.

Cross border concerns are legitimate, so I’ll give him that. However, if it was never stated anywhere that the ONLY remote location is one that is agreed upon by the company, then it does not matter where they are as long as they get the work done.

I understand the legal concerns, working in another country could have certain tax/legal implications. The other complaints are dumb though, if he's getting his job done then who cares what else he's doing?

The issue is the location where you work can impact how the employer reports and withholds on your earnings. There's also a security issue with sensitive client data being in a foreign country. If he had worked from Florida or somewhere within the states, there is little to no issue.

Simply on the US/Mexico work visa legal issue, I agree with the company, everything else is crap, but a legitimate legal concern, especially an international one, is grounds for dismissal.
