The late Lord Bingham of the United Kingdom was invited, around 2005, to redefine the concept of the “rule of law.” What necessitated this redefinition, given that the revised formulation appears to render the rule of law substantially equivalent to the principles of the common law? Was the retention of these dual definitions intended to enable jurisdictions to be alternated fluidly in a manner that would escape public notice?
