UPDATE | Ashley Flynn Murder Case A significant ruling came down this week in the Ashley Flynn murder case. The judge denied the prosecution’s request to automatically allow two child witnesses, ages 9 and 12, to testify behind a screen that would prevent them from seeing the defendant. searchresults.pdf It’s important to understand what this ruling does NOT mean. The judge did not say the children cannot testify. The judge did not rule that protective measures can never be used. Instead, the court ruled that prosecutors must first present case-specific evidence showing why those particular children need the accommodation. The judge found the state relied primarily on Ohio’s child witness statute without presenting evidence demonstrating that these children would be traumatized or unable to testify in the defendant’s presence. searchresults.pdf The decision cites both Ohio and U.S. Supreme Court precedent holding that a defendant’s constitutional right to confront witnesses face-to-face can only be limited when a judge makes individualized findings that the protective measure is necessary. searchresults.pdf In other words, this ruling is about procedure and constitutional rights, not about the credibility of the child witnesses or the strength of the prosecution’s case. The state can still attempt to seek these protections again if it presents additional evidence supporting the request. What do you think? Should courts require individualized proof before shielding child witnesses from a defendant, or should those protections be automatic for children in cases like this? #AshleyFlynn #TrueCrime #OhioNews #CourtUpdate #CalebFlynn
