There was obviously a lot of traffic in and out if this house not to mention the environment her mother had her in before she went to live with the grandparents or while she was visiting her mother.

If there is not direct DNA linking him and they do go forward with that part of the case, it would be appealable. I imagine the judge is looking at evidence in its totality and seeing that they can get him on the murder charge. That could also be a reason for the jury to assume reasonable doubt on both charges. He probably just doesn’t want to risk that.

Between the hospital throwing them out and the police not going back and finding those underwear… I’m just in shock. At this point, even back then, there’s just no excuse for that kind of carelessness. That house and family was disgusting and at the very least the grandma and grandpa should be charged with child neglect. David is the likely suspect, but the evidence is unfortunately lacking and all we can do is hope the jury gets it right. everyone that's asking how in the world the judge is doing this or why he's literally following the law it doesn't sound right but it actually is and that is why this case has taken 9 years to even go to trial obviously somebody did this to that little girl but unfortunately no direct DNA evidence or any other physical evidence was actually left behind I really hope that she gets Justice and this does not fall between the cracks
