According to documents obtained by PEOPLE, she opposes it during her custody hearings with ex Olivier Martinez. Berry, 60, claims Martinez is dismissing other eyewitnesses to the alleged September 26 incident. They include her daughter Nahla, 18, and her fiancé Van Hunt. She wrote that Hunt “was physically present during the incident and is the only adult third-party eyewitness.” She also claims Maceo has spent the last two weeks mostly in Martinez’s care. She says Martinez admits he has discussed the allegations and the case with him. She asks the court to be careful about giving “substantial weight” to what she calls a “coached and manipulated child.” Martinez’s lawyer, Patrick Baghdaserians, denied it. “The child is the primary victim here,” he said. “Victims of ab*se should be able to testify.” Martinez, 60, filed for sole custody on October 1. He claims Berry “physically ab*sed” Maceo on September 26. Berry denies it. “I would never hurt our child,” she wrote in an October 5 declaration.
