Omg, I watched this today and the whole time I was thinking, “This is what Sullivan should have done!” This judge exhausted all avenues before declaring a mistrial.

Massachusetts actually uses particularly strong language in its reasonable doubt instructions, describing the standard as requiring “the highest degree of certainty possible in matters relating to human affairs.” While the legal burden of proof is the same nationwide, different wording could influence how jurors psychologically interpret reasonable doubt. That raises a legitimate question about whether Massachusetts jurors might be more hesitant to convict, potentially contributing to deadlocked juries and mistrials. Of course, that would need to be supported by actual data.

how are they able to sub in a new juror when both sides have concluded their cases? wouldn't the new juror be missing all the evidence presented by both sides?

The Clancy case needs to be written off and put down to experience and lessons learned because it was a shambles.
