The President, having sworn under Schedule 2 of the Constitution to uphold, defend and respect the Constitution and to advance the Republic, has failed in his obligation under Section 7(2) to respect, protect, promote and fulfil the rights of South Africans to safety, security and livelihood. Through a refugee and immigration system that integrates unvetted and undocumented foreign nationals into communities without consultation, security screening or criminal vetting, South Africans have been exposed to proven harms: zama-zamas involved in mass killings and illegal mining, spaza shop mafias that threaten and prevent South Africans from operating spazas in their own townships, Somali networks in Mayfair chasing South Africans out of business precincts and operating as CPF members while being complainants, and widespread building hijackings in Johannesburg and elsewhere by unvetted foreign nationals. These are not allegations but documented crimes where communities were forced to accept integration without consent, while the consequences are borne by township residents, not by those who took the oath and reside in high-security estates.
