Diego Hernandez was 25 when he died in April, about seven months before his November 20 wedding at Posey Meadows outside San Marcos, Texas. He and his fiancée had already paid the venue $15,909.28. After his death, the family requested a refund. The venue refused, citing a contract that forfeits payments upon cancellation but contains no provision addressing a client’s death. His fiancée filed suit in July. Posey Meadows countersued, alleging breach of contract over her refund request and refusal to pay the remaining balance. The venue also alleged that proof of Diego’s death had not been provided. Her attorney told KSAT he offered the death certificate before filing suit but received no response. It is now in the court record.
