This happened to me. I got charged with dui drugs. The cop said my eyes were red and twitching. (I just chugged a Red Bull after a 12 hour shift) he immediately arrested me. We go to the hospital to get a blood test and then to the jail. I get bonded out, they take my license away and it takes 3 months for my drug test to come back. My test comes back completely clean with nothing in my system and they drop all my charges. I was just baffled I went through that for literally NO reason. The cop didn’t even pull me over, I was parked on the side of the road talking on the phone before I lost cell service. Body came footage came back from the cop and he literally had a bud light in his truck I guess and he opens it, dumps it and throws it in my car and said “I can get her for open container too” granted that charge never showed, but my lawyer caught it on the body camera apparently. (I never saw the video) this was 10 years ago, and haunts the heck out of me still.

So police don’t get to determine what the state attorney decides to charge u with, the state determines based off the probable cause affidavits what they believe they can prosecute u for, if ur attorney did a plea in Absentia (aka without u present) she would’ve needed a document that u signed accepting the deal…¿

I was charged with a DUI once and I wasn’t under the influence of anything. My ex had called the cops on me bc I wasn’t home. When he pulled me over. I failed the field sobriety test bc we wanted me to say my abcs backwards, count backward by three from one hundred, etc. They drew blood after I blew nothing on the DUI test. When my court date came up, they said I had the therapeutic amount of one antidepressant, and less than the therapeutic amount of the other one in my blood. I was going to have to miss work and go on trial. I plead guilty bc I didn’t want the county attorney and couldn’t afford a decent lawyer.

I feel for you. I was arrested after I totaled my car. They tried to charge me with a DUI, child endangerment, speeding, Wreckless Driving and something else. I was honest with the cop about what was in my purse. He saw I had my anti anxiety meds in there and accused me of being under the influence. He arrested me, took me to the fire dept where they drew my blood. Long story short it cost me $7k to beat the charges, when there was nothing in my blood system. The county wouldn’t admit to being wrong. 😑
