@flyingsmokey: Early this morning, ICE agents were spotted in Northwest Fresno. During the incident, I was struck as a pedestrian by a vehicle being operated by an ICE agent. The vehicle then left the scene. I followed from a safe distance while contacting 911 so law enforcement could locate and identify the driver. The vehicle continued northbound on Highway 99 toward Madera, where the California Highway Patrol eventually stopped it. CHP identified the driver and later released the individual. I informed CHP that I wanted the incident documented and wanted to pursue criminal charges. However, because the individual involved was a federal agent, I had serious concerns regarding my privacy and the possibility of retaliation. I therefore chose not to provide additional identifying information at that time. ⚖️ KNOW YOUR RIGHTS: • Marsy’s Law — California Constitution, Article I, § 28: Crime victims have constitutional rights to privacy, dignity and protection from intimidation, harassment and abuse. California Penal Code § 679.026 requires law enforcement agencies investigating criminal acts to make information regarding these rights available to victims. • Federal agents are not automatically exempt from California criminal law. In January 2026, the California Department of Justice issued Law Enforcement Guidance Statement 2026-DLE-07, confirming that California state and local law enforcement have authority to investigate potential violations of California criminal law committed by federal agents. State and local agencies are not required to simply defer to federal authorities. I am preserving the available evidence and intend to pursue the appropriate avenues regarding this incident.
