American Eagle and Smiley released sweatpants and sweatshirts featuring the phrase “Smile More,” which Roman Atwood’s brand has used for years. Smile More is now suing them for alleged trademark infringement. Roman claims that multiple (cease-and-desist) letters were sent before the lawsuit, in the bio of his latest video.

They're gonna lose this lawsuit by a landslide, defense is going to bring up the fact that the term "smile more" has been around since at least the 70s when practically every hippy had a shirt with a smiley face on it and some of them had the term "smile more" on them. Roman Atwood is acting like he coined the phrase. Pretty positive AE and Smiley didn't even know who he was before they made that apparel line. It's not like it's some profound phrase that takes more than 2 brain cells to think of, maybe if they used that smiley swoosh Roman uses in his branding under the smile more wording. Or if the font was the same, But they used a regular smiley face and the font is not the same.
