Suspects in 2019 Fresno mass shooting could face trial as evidence is revisited FRESNO, Calif. (KFSN) -- Nearly seven years after one of the deadliest mass shootings in Fresno history, prosecutors are once again attempting to send three accused gang members to trial after a court overturned the original preliminary hearing. Ger Lee, Billy Xiong and Anthony Montes returned to court this week, each facing multiple murder and attempted murder charges in connection with the 2019 backyard party shooting that left four people dead and six others wounded in east-central Fresno. The case is being reheard after an appellate court determined the defendants' speedy trial rights had been violated during the original proceedings, requiring prosecutors to present the evidence again. A fourth defendant, Porge Kue, was also charged in the attack but died in custody in 2024. Lee and Montes remain eligible for the death penalty if convicted. Prosecutors allege the shooting was carried out by members of a street gang seeking revenge for the killing of Randy Xiong earlier the same day. However, authorities have repeatedly noted that none of the victims killed at the backyard party were members of a rival gang. On Friday, jurists heard testimony shedding new light on that alleged motive. Randy Xiong's brother testified that a group of men stormed into their home looking for another sibling who was involved in gang activity but encountered Randy instead. "I chased them outside, trying to see what kind of car they were driving at least. But I loved my brother so much, I came back. I called 911 right away," he testified. The witness described Randy as a developmentally delayed young man with no gang affiliations. "Randy. He's a good person. He's actually a special ed person. He was young, very young. So he's just a good kid," he said. The testimony is part of what is expected to be a lengthy preliminary hearing. With three defendants being tried simultaneously, each represented by separate attorneys, witnesses are being questioned multiple times by both prosecutors and defense attorneys. Several days of testimony are expected before a judge determines whether the men will be ordered to stand trial. The criminal case extends beyond the three defendants in court. Federal court documents allege Pao Vang, 30, Jhovanny Delgado, 19, and Johnny Xiong, 25, were also involved in the events surrounding the shooting. Prosecutors allege the men acted as lookouts and conspirators in the attack and were later federally indicted on charges that include conspiracy to commit murder. The preliminary hearing is scheduled to continue next week. If prosecutors are successful, Lee, Xiong and Montes will once again face trial for the 2019 mass shooting that killed four people and injured six others.
