Detective Jeff O'Driscoll of the Summit County Sheriff's Office in Utah was going to testify in Kouri Richins' murder trial today, but Judge Richard Mrazik moved his testimony to Wednesday to give Richins' lawyers time to review a transcript prosecutors want to use in their exam. The transcript is of O'Driscoll's interview with Richins' housekeeper Carmen Lauber, who testified earlier in trial that she got Richins the pill with fentanyl that killed her husband, Eric Richins. Prosecutors want to introudce statements she made to O'Driscoll because they believe they contradict some of her testimony and can be introduced as prior inconsistent statements under Rule 801 of Utah's Rules of Evidence. Defense attorney Wendy Lewis' microphone picked up her muttering a profanity before she asked the judge to delay the trial for two days to give them time

Prosecutors want to introudce statements she made to O'Driscoll because they believe they contradict some of her testimony and can be introduced as prior inconsistent statements under Rule 801 of Utah's Rules of Evidence. Defense attorney Wendy Lewis' microphone picked up her muttering a profanity before she asked the judge to delay the trial for two days to give them time "to go through all the 1,000 pages again and figure out what portions should be let in." Lewis referred to Rule 106" of the Utah Rules of Evidence, which says if a party introduces all or part of a statement, "an adverse party may require the introduction, at that time, of any other part — or any other statement — that in fairness ought to be considered at the same time. The adverse party may do so over a hearsay objection." "I guess we're going to go through the whole transcript and find out what we want included under Rule 106," Lewis told Judge Mrazik. Mrazik rejected her request for a two-day continuance but agreed to move O'Driscoll's testimony to Wednesday (March 11, day 12) and gave the defense until 6 p.m. MST today to identify which portions of the transcript they want shown to jurors.Jurors are due back at the Silver Summit Justice Center near Park City at 1 p.m. MST on Wednesday. The attorneys will be in court at 8:30 a.m. MST to discuss the transcript portions the defense identifies, and Judge Mrazik will decide what's allowed.Jurors are due back at the Silver Summit Justice Center near Park City at 1 p.m. MST on Wednesday.
