But not in the way that you think. In sports and in school, there are ground rules for fair play. We are raised to expect the same in other institutions, including the court system. But many will inevitably end up disappointed and frustrated with what actually goes on. Even with the best ##divorcelawyerand the most impartial judge. As a litigant, you are expecting a referee to come out, blow the whistle, and enforce the rules. To impose penalties and make quick calls. And to make sure the outcome is fair. But that’s not what a judge does. A judge is mandated to consider evidence (or the lack thereof). And sometimes the evidence is not in your favor. ⚡️ Here are some examples: ⚡️ 1. You are in a 10 year marriage, but you have been contributing to your 401(k) for 15 years. Therefore, the first five years would be considered separate property and presumably, you don’t have to share that portion with your spouse upon divorce. Not so fast. Here’s the problem: you don’t have proof of the ##separateproperty You cannot locate the 401k statement from your first day on the job. So although there might be a presumption of separate property, there is no proof of separate property. Your spouse is gloating. Their lawyer is smirking. The judge is going to divide that asset equally because that what is what he or she is mandated to do. This applies to other financial issues as well, including who incurred the credit card debt, and the claim of separate property against the equity in a marital home. 2. Here’s another example as it relates to custody. Perhaps you are a stay at home spouse who sacrificed career and income opportunities to raise three children. You put in nearly all of the caretaking effort over a 15 year marriage. The harsh truth upon divorce is you are not necessarily rewarded for the effort. The judge is mandated to look at the best interest of the child, who will be living in two separate households once the separation and divorce goes into effect. And it is very likely that parenting time will be shared across those two households. This can seem very unfair to the spouse who made the sacrifices, especially because he or she will not receive the financial support expected or deserved. This is why ##prenuptialagreements are increasingly being viewed as necessary, financial tools to reduce risk caused by marriage, including litigation risk upon divorce. In the state of New York, custody issues cannot be addressed in a prenup. But ##spousalsupportcan be. Be warned however. Staying home to care for children is a very risky choice in today’s economy. And it’s not just divorce. Even if you are happily married, the disability or death of your spouse could put you in a very precarious situation.
