For the third time, Senator Jinggoy Estrada is facing plunder charges following the Ombudsman’s filing of non-bailable cases against him over his alleged involvement in the massive flood control scandal. Under Republic Act No. 7080, plunder is committed when a public officer amasses ill-gotten wealth amounting to at least P50 million, either personally or in conspiracy with others, through a combination or series of overt criminal acts. Estrada was first indicted for plunder in 2001 as an alleged co-conspirator of his father, former president Joseph Estrada. The charges involved the alleged acquisition of P545 million in protection money from jueteng operations, the diversion of P130 million in tobacco excise tax shares intended for Ilocos Sur, the collection of P189 million in commissions from Belle Corporation after allegedly compelling the GSIS and SSS to purchase shares worth P351 million and P329 million, respectively, and the deposit of P3.23 billion into a bank account under the name, “Jose Velarde.” While former president Estrada was convicted, Jinggoy Estrada was acquitted of plunder in 2007 for lack of evidence. In 2014, Estrada faced another plunder case over the alleged misuse of his Priority Development Assistance Fund (PDAF). He was accused of embezzling P183 million from his discretionary fund in the pork barrel scam. He was later acquitted of plunder for lack of reasonable doubt and was also cleared of direct and indirect bribery charges. However, his graft cases before the Sandiganbayan remain pending. Despite his previous acquittals, Estrada now faces plunder and graft charges in connection with the multibillion-peso flood control scam. Assistant Ombudsman Mico Clavano revealed that Estrada allegedly received P573 million in kickbacks that were “systematically delivered” to him. If convicted of plunder, Estrada could face the penalty of reclusion perpetua. As plunder is a non-bailable offense when evidence of guilt is strong, he may also face detention pending trial. As of writing, the Sandiganbayan has issued arrest warrant against Estrada for bailable graft case. The anti-graft court has yet to issue the warrant for plunder charge. #philippinestar #newsph #jinggoyestrada #plunder #floodcontrol
