@freightrixfilesloadinggg: TQL Files Response in RICO Case, Blames Carriers’ Poor Business Practices for Lost Freight Cincinnati, Ohio — TQL has filed the first response in the RICO case brought by a group of carriers against giant 3PLs C.H. Robinson and TQL. In three individual motions filed Monday in the U.S. District Court for the Eastern District of Texas, TQL is seeking dismissal of the case. TQL argues first that its practices do not rise to the definition of corrupt activity under the Racketeer Influenced and Corrupt Organizations Act (RICO). Second, the company argues the case is in the wrong court. TQL says the carrier plaintiffs — Stevens Trucking, Western Flyer Express, Christenson Transportation, E.O.S., and IWS Motor Freight — agreed in their carrier contracts to litigate any dispute with TQL exclusively in state court in Clermont County, Ohio. Clermont County is a suburb of Cincinnati, where TQL is based. The agreements expressly choose Ohio law, according to the filing. TQL also seeks to remove IWS Motor Freight from the case, arguing it is not based in Texas and had no direct contract with TQL and conducted no business with TQL. On the merits, TQL argues the carriers’ claims are actually a dispute about losing freight to a lower bidder, the likely result of their poor business practices. TQL says the carriers cannot plead a single TQL act that caused a single lost account, and that low rates, carrier noncompliance, and a declining freight market do not establish racketeering or false advertising. The company also disputes claims about falsified records, saying records were only received by TQL, not created by it. C.H. Robinson has yet to file a response to the lawsuit. #Trucking #trucktok
