But you’re presupposing that the corporation is liable and that’s the point of the court system

Choam_Nomsky :
In a multicultural, post-modern, multi-ethnic society and culture, where there are many different concepts of morality and "right and wrong" how can you speak so authoritatively about morality, as if it is obvious what right and wrong are? What morality are you advocating for and where does it come from? Sounds like white-coded, Western-thinking.

I would love to see a group of volunteers to find lawyers who violate their bar's ethic rules and file complaints for delay tactics, abusing discovery, ...

Love your content. So interesting. I wonder if this amorality has worsened or if it’s taken me decades to realize? I’m in public health policy and I naively thought all my colleagues in grad school were there because they also cared deeply about things like health equity, universal care, harm reduction etc and was surprised when many went to work for big insurance and pharma. I did not and have consequently had a most clear conscience working in environmental health and public health for non profits. I’m currently with an FQHC (and I know non profits are not without ethical issues either). I feel like capitalism has seeped into every single area of our lives and we have been programmed to think of money as - for lack of better word - god. ALL of that said, they don’t make well loved movies or write books about morally compromised professionals. Just watched the film “Dark Waters” this weekend about attorney Robert Bilott and his work against DuPont and was reminded that there are professionals who do have strong moral compasses. Lastly, I’ve always wanted to like the person I see in the mirror so I’ve tried to remain true to the truth. I’m disheartened by so many people who don’t seem to really give a fuck about anything beyond the almighty dollar.

There are several major ethical theories (or moral frameworks). There is also a difference between basing actions on what is right or wrong versus good or bad outcomes. How could you make all lawyers conform to one? I’m sure some could make a strong utilitarian argument supporting the representation of large corporations based on the broader societal benefits of ensuring access to counsel, protecting due process, and maintaining an adversarial legal system 🤷🏽‍♂️

That’s exactly why I have my own law practice. I never want to be in a position where I’m obligated to represent unethical corporations or individuals whose actions I believe are morally wrong or not undertaken in good faith. Having my own practice gives me the freedom to choose whom I represent without compromising my principles.

It’s not about thinking about a lawyer, it’s a filter tool meant to create barriers to the credentials. It also keeps people complacent because who’s going to turn down a six figure offer when you have six figure loans to pay off.
