Of recent, it seems the constitutional court is intentionally moving agaist the people of South Africa, and even the written law itself. In its recent judgements, It is as if they first gauge what the people want, so that they can make judgements in contrast to what the people want. On its own, the constitution of South Africa is a book of noble laws meant to protect south africa's national sovereignty and the individual rights of the people of South Africa. From the bill of rights to immigration laws and labour laws, it all was crafted for south Africans to live comfortably under a legal system that does not make their lives difficult. However, the interpretation and enforcement of those laws can either make or break south africa. The recent judgement by the constitutional court regarding asylum seekers and illegal immigration in the country, was one example of a constitutional court which has no ear on the ground and doesn't care what the people say. With all the mass protests by South Africans agaist illegal immigration in the country, the court managed to make a judgement that invalidates what south africans want, which is the enforcement of the immigration law. Speaking to SMWX podcast host, justice Madlanga spoke agaist a constitutional court or even a constitution that is not living to the feelings and demands of the people. Madlanga said the constitution is a living document that has to keep adjusting to the timely needs and wants of the people. He said it must respond to what the people think and feel. "the constitution must be responsive to what people on the ground think and feel. We must listen closely and hear what they say", said Justice Madlanga. Contrary to the iron wall constitution and constitutional court that we see today, Madlanga says the system has to follow and listen to what the people feel and want. At this point, the people are agaist illegal immigration, and the fact that "illegal immigration" is already illegal in the law of South africa, it should be easy for courts like the constitutional court to be responsive to what the people want. But that is not what the constitutional court did under the leadership of chief justice Maya. Even though south Africans had already accepted that they have a corruot government, which cannot get anything right, now they are learning that they also have a constitional court that is not responding to what they want. Yes, the constitutional court cannot change the law, but the justices of the court can, at least, interprete the law inline with what is good for the country and the people of South Africa.
