A Florida man who offered to plead guilty to murder in exchange for a Philly cheesesteak, fries and Pepsi changed his mind today about representing himself in his murder trial. Robert Kessler, 74, ditched his lawyer on Monday and went pro se, but he told Judge Nick Nazaretian in Florida's 13th Judicial Circuit Court in Tampa this morning that he wanted her back. "That is your decision at this moment, sir, is that you no longer want to represent yourself and want Ms. Dunker to take back over the case that she's had for five years?" Nazaretian asked. "Yes, I do," Kessler said. "Do you make that decision freely and voluntarily?" Nazaretian asked. "Yes, I have," Kessler said. "Has anyone forced you, coerced you, threatened you in any way, shape, or form to make that decision?" Nazaretian asked. "No," Kessler said. "It's your own free will?" Nazaretian asked. "Yes, sir," Kessler said. "Okay," Nazaretian said. Maria G, Dunker, a public defender in Hillsborough County, was in court as Kessler's standby counsel and told the judge she was prepared to begin trial. "You were ready to go yesterday, correct?" Nazaretian asked. "Yes," Dunker said. "Very good. Alright. Well, then I'll find that he's freely and voluntarily waived his, I guess, right to represent himself now, and he's gone back to his attorney. So now, Ms. Dunker is your lawyer, so she will make all the legal decisions, with the exception of perhaps one or two down the road that we'll address in a few days, perhaps. But we are now ready to go," the judge said. Kessler is charged with second-degree murder and abuse of a body. He's accused of murdering Stephanie Crone-Overholts, 47, and dumping her dismembered remains into McKay Bay in November 2021. He first was declared incompetent for trial and housed in a psychiatric facility, but, after treatment, a judge ruled in March 2025 that he was now competent. #law #crime #court
