The guy could countersue and win. notification is irrelevant when it comes to driveways and roads. The construction company has a legal obligation to physically block every access area and the construction area to prevent people from entering the area. unless this guy moved physical barriers, he will win in a countersuit.

While they pave you park you car on the unaffected part of the street. You walk from your home to your car. You can walk on concrete within a day but no vehicles for 5-7 days.
