Lindsay Clancy returned to court today for a hearing in her murder case over the strangulation deaths of her children. Judge William Sullivan heard argument about her motion to dismiss, which argues a second trial would violate the constitutional prohibition on double jeopardy. Clancy's lawyers argue the juror who didn't vote not guilty should have been questioned about what other jurors said was his refusal to follow the law on reasonable doubt. Sullivan has not yet ruled on the motion. Clancy still is charged with three counts of murder for strangling her children, 5-year-old Cora, 3-year-old Dawson and 8-month-old Callan, in their home in Duxbury, Massachusetts, on Jan. 24, 2023. 24, 2023. Appellate specialist Martin Weinberg argued the dismissal motion today at the courthouse in Plymouth. He quoted Founding Father and President John Adams, "who grew up 25 miles north of here." Adams called the jury right "the right central to the federal and state constitution, the lungs of a democracy." The exact quote is: "Representative government and trial by jury are the heart and lungs of liberty. Without them we have no other fortification against being ridden like horses, fleeced like sheep, worked like cattle, and fed and clothed like swine and hounds." "We respectfully contend that these notes that were written on behalf of the jury, called into question whether or not the jury trial right that Ms. Clancy was entitled to of 12 jurors deliberating in good faith and following the law was or was not being complied with by the jury in the secrecy of its deliberations," Weinberg said. He was referring to the notes the foreperson wrote saying a juror “is unable to follow the instructions regarding reasonable doubt," then saying the juror “made statements acknowledging doubt, but refused to apply it to the verdict as the law states." Judge Sullivan said he appreciated the Adams quote but indicated it was unnecessary. "As someone who lived and worked in Quincy for many many years, who drove by President Adams' house every day for 35 years, who actually has a bobblehead of John Adams, I try to remember all of President Adams' lessons and writings. So I will also try and remember those lessons when I'm making this. So I appreciate everyone's arguments. The writings were excellent and very helpful. But I'm going to take this under advisement, and I'll get this out as soon as I can," he said. You can watch the entire hearing on my YouTube channel and Facebook page. #law #crime #court
