BASEL 3.5 the stick holding back a five-ton bolder. This December they either define regulation for RIPLLE and XRP or they get left behind.
Minimal viable criteria for BASEL 3.5 to shift RIPLLE and XRP’s asset class.
One: atomic settlement finality. The transfer is irrevocable the moment it hits the ledger — no correspondent chain, no pending state, no T-plus-two. This is the functional core. It’s testable: you either have it or you don’t.
Two: no issuer dependency. Value doesn’t rest on a claim against a balance sheet. No redemption window, no reserve pool, no par peg. This is what kills the flood — algorithmic tokens, meme coins, and every hopeful with a whitepaper fail here instantly, because they all depend on someone standing behind them.
Three: demonstrated institutional throughput. Not market cap — volume of actual settlement transactions between regulated entities over a trailing period, say twelve months. This filters for utility, not hype. XRP’s cross-border payment volume clears it; most tokens don’t.
Four: independent custody available from supervised institutions. Keys held by qualified custodians under regulatory oversight, with bankruptcy-remote segregation. BNY custody is the proof point this exists.
Five: legal enforceability of transfer across jurisdictions. A recognized legal framework — not necessarily one specific law, but documented recognition that the transfer moves value cleanly under conflict-of-law principles. This is the hardest one because it requires jurisdictions to agree, which is where the politics live.
That’s it. Five tests. Pass all five and you’re in a defined settlement-asset bucket with risk-weighted treatment far below twelve-fifty — maybe one hundred to two hundred fifty percent, comparable to what cleared derivatives get. Fail any one and you’re back in Group 2b.
The elegance is that property two does the heavy lifting on flood control while property one does the heavy lifting on function. Everything else is operational proof. And none of the five names XRP — which is exactly why it’s survivable inside a consensus body that can’t afford to pick winners by brand.
The one I’d watch most closely is property five, beca
