@officiallindsayclancy: 🚨 PATRICK CLANCY’S WRONGFUL DEATH LAWSUIT. TODAY’S HEARING IS OVER, AND I HAVE SOME THOUGHTS. I just finished watching the hearing in Patrick Clancy’s wrongful death lawsuit against Lindsay’s mental health providers, and I have A LOT of thoughts. Especially after everything we heard during Lindsay’s criminal trial. Patrick was not in attendance today. His attorney, Howard Cooper, appeared on his behalf. The medical providers are asking the judge to throw out Patrick’s lawsuit, arguing that Lindsay never communicated an actual threat or intention to harm her children. They acknowledged she experienced intrusive thoughts, but argued that intrusive thoughts are NOT the same as wanting to act on them. And that distinction is important. BUT THEN HOWARD COOPER STOOD UP. And I thought he made some VERY compelling arguments. His biggest point? THIS IS NOT JUST ABOUT WHETHER SOMEONE SHOULD HAVE WARNED PATRICK. THIS IS ABOUT WHETHER LINDSAY RECEIVED PROPER MEDICAL CARE IN THE FIRST PLACE. Cooper argued that the lawsuit contains EIGHT allegations of negligence, including poor communication between providers, concerns about medication management, failure to recognize her deteriorating condition, and continuing virtual appointments when in person evaluations allegedly should have occurred. He argued that the defense was focusing on a duty-to-warn claim instead of addressing the broader allegations of medical negligence. AND THEN CAME THE PART THAT REALLY GOT MY ATTENTION. Cooper pointed out that Lindsay has NOT testified in this civil case. He said they expect her to eventually testify that she DID tell her medical providers she was experiencing homicidal thoughts and feared something terrible could happen to her children. READ THAT AGAIN. The defense is arguing Lindsay never communicated an actual threat. Patrick’s attorney is saying Lindsay herself is expected to testify otherwise. Now, that testimony hasn’t happened, and we don’t know exactly what Lindsay will say under oath. But that’s a pretty significant disagreement. AND THE MEDICAL RECORDS? Cooper referenced reports of Lindsay experiencing severe anxiety, racing thoughts, feeling disconnected, not wanting to be left alone, and fearing something terrible was going to happen. He also brought up December 2, when Lindsay reportedly expressed that she didn’t want to be here, felt like she was going to die, and didn’t care. And then there was a 17 MINUTE ZOOM APPOINTMENT with Dr. Jennifer Tufts during which Lindsay reportedly expressed fears that something terrible might happen. I’m not saying a 17 minute appointment automatically means negligence. But after hearing everything during Lindsay’s criminal trial about her mental health, medications, lack of sleep, and how many times she sought help, I think it’s reasonable to question whether anyone was seeing the FULL picture. Were these providers communicating? Were they connecting the symptoms? Was her condition getting worse without anyone recognizing just how serious things had become? HERE’S SOMETHING ELSE I FOUND INTERESTING. Cooper argued that when a mother of three young children is experiencing serious mental health symptoms, providers need to consider the potential risks beyond just the patient. He also suggested that a mother who fears losing her children might be reluctant to admit she’s afraid of hurting them. Now, I want to be VERY clear. Suicidal thoughts do not automatically mean someone is a danger to their children. Today’s hearing was NOT about deciding whether the doctors were negligent. It was about whether Patrick’s lawsuit has sufficient legal grounds to continue. And Cooper made it clear that he believes these allegations deserve to be examined through the legal process. I’ll continue following this closely and will update everyone when the ruling comes down. ❤️#lindsayclancycase #court #lindsay #patrickclancy #courttv

It's your one :
Surely the health providers could argue that there is no solid proof she hurt her children other than what Patrick's said?

DEPLORABLE.. DA in the previous case gave Mr Patrick, a pass on his criminal negligence.. NOW THEY WANT ANOTHER PASS .. STATE LAW SAYS .. leaving your children with someone you know, is mentally ill, and there's an injury / worse.. FELONY CRIMINAL NEGLIGENCE
