So we're in Dedham. Norfolk Superior Court. October 28th, 2026.This is NOT Lindsay's criminal trial. This is Patrick Clancy's OWN civil case the wrongful death lawsuit he filed himself on behalf of his three babies Cora, 5, Dawson, 3, and Callan, just 8 months old all dead on January 24th, 2023 in Duxbury. Who is he suing? He's suing the people who were treating Lindsay in the weeks before it happened Dr. Jennifer Tufts, psychiatric nurse practitioner Rebecca Jollotta, Aster Mental Health, and South Shore Health. Patrick's lawyers Howard Cooper and Maria Davis get up and they lay it all out. They say Lindsay wasn't quiet. She was telling them. That she was having suicidal thoughts AND homicidal thoughts "as to her children" their exact words. That she was worried something awful was going to happen. That the providers knew she had been experiencing thoughts of killing her children and didn't properly respond to her psychiatric struggles and medication changes. And then they drop what everyone in that courtroom was waiting for they say Lindsay herself will testify in this civil case once her criminal case is over. That she will get on that stand and say under oath that she explicitly told them she was homicidal toward her kids. Now here's where you have to pause because you can't make this stuff up. The providers' lawyers get up and they swing right back. They said the whole complaint is “speculative and conclusory" and lacks a good-faith factual basis.And under Massachusetts law, they argued, a mental health provider doesn't owe a duty to third parties meaning Cora, Dawson, and Callan unless the patient has a history of violence or made a very specific, imminent threat. They're claiming they're shielded by M.G.L. c.123 §36B. And legally? That's actually a strong argument for dismissal, even if it sounds cold to hear. This is a wrongful death suit.If Patrick wins, that means money. A payout. And for most people watching, especially the team that still has questions about Patrick's own timeline that day the ThreeV takeout order, the CVS run at 5:32 PM, the text about Pedia-Lax as he was leaving, leaving her alone at bedtime that part is hard to swallow. There's a whole side of the internet that still says Patrick needs to be investigated again, and that conversation is not going away. Patrick didn't even show up to his own hearing today.Not in the courtroom at all. So what happened? No ruling.The judge took the providers' motion to dismiss under advisement. He didn't throw it out, he didn't let it go forward we wait for a written decision, could be days, could be weeks. If it's dismissed, Patrick's wrongful death case is done. If it's denied, it goes to *discovery* — and THAT'S when it gets interesting. Emails, medical records, therapy notes, prescription changes, depositions — everything comes out. Remember — this civil case is totally separate from Lindsay's criminal case. Her murder trial ended in a *mistrial on September 4th after 7 days, with reports of an 11-1 split for not guilty by reason of insanity.* Her next big fight is *November 2nd — the double jeopardy hearing* over whether the DA can even retry her at all. So today wasn't about justice for Cora, Dawson and Callan the way people want to see it. Today was about whether a court will even let Patrick's lawsuit survive and whether the people who were supposed to catch this should have caught it, when so many people still have unanswered questions about everyone involved.
