A trans woman says she was unlawfully arrested by ICE, held in a men’s facility and subjected to a genital examination. On 26 October, 33-year-old Clara Tan arrived at Rochester airport in New York after attending an anime event in California. She claims four ICE agents approached her outside the terminal, said they had a warrant but initially refused to show it, then tackled her and handcuffed her. In a Facebook post describing the incident, Tan wrote: “I hear a godawful crack and there’s suddenly a very familiar pain in the left ball of my foot, while they’re cuffing me behind my back.” She was taken to a detention facility in Batavia, where she says she was “thrown into a metal box, not larger than 6x10, with a toilet bowl in the corner and absolutely no privacy.” Originally from Singapore, Tan moved to the US in 2019 to attend the American Musical and Dramatic Academy in New York. She filed for asylum that year and held a work permit. After waiting for hours, Tan says she was finally entered into ICE’s records and shown the warrant. She claims the grounds for her arrest included being Singaporean, not being a US national, entering the country on an “unknown date” and at an “unknown point of entry”, and allegedly not attending the academy. While she does not dispute the first two points, Tan says her passport recorded her date and place of entry, and that her graduation certificate and publicly available photos and videos could prove she attended the academy. Tan says she realised she was the only woman at the facility and was told Batavia was a single-sex centre that housed pre-operative trans women. When she asked a guard about the arrangements, he allegedly replied: “We don’t house women here. That should answer your question.” After Tan told him she was not a man, she says he asked, “Do you have your junk?” When she answered no, two female medical staff members inspected her genitalia.
