The San José Police Department announced felony charges against two officers accused of tampering with evidence and filing a false police report. Raydarius Surry, 29, and Destiney Thompson, 30, surrendered on the evening of October 28 and were subsequently released on bail. The investigation began over a missing bag of suspected narcotics. Police said Surry documented the item in a report concerning a May 3 arrest, but the department discovered in August that it had never been booked into evidence and notified him. Investigators allege that Surry then stopped a pedestrian unrelated to the original case and seized another, similar bag of suspected narcotics without documenting the stop or seizure. He allegedly booked that item under the May case number, substituting material from a different encounter for the missing evidence. Thompson allegedly reviewed Surry’s body-camera footage from the May arrest to help plan the replacement. Police and news reports described the officers as being in a romantic relationship. Each faces one count of evidence tampering and one count of filing a false police report. The available material does not establish that either has been convicted. SJPD said investigators reviewed the officers’ previous cases, arrests and evidence bookings and had not found other similar discrepancies. The department also referred the matter to California’s Commission on Peace Officer Standards and Training for a temporary decertification review. That referral does not establish that their certifications have already been permanently revoked.
